JAMES OTOO AND BEATRICE OTCHERE DARKO vs. DAVID ODAMTTEN ABBEY AND 4 OTHERS

INTRODUCTION 1.0 The Plaintiff sued out this writ against the Defendants jointly and severally for the reliefs indorsed on their writ of summons. 1.1 The Plaintiffs amended their Writ of Summons and statement of claim on a number of occasions and thus the last amended Writ of Summons and statement of claim were those filed on 18th April, 2019. 1.2 By their Further Amended Writ of Summons, the Plaintiffs sought as many as 13 reliefs, most of which were declaratory in nature. 1.3 The Defendants also variously amended their Statement of Defence on several occasions in which Amended Statements of Defence, they denied the Plaintiffs’ claim in its entirety. 1.4 Suffice it to say that at the close of pleadings, several issues were set down for trial. But I must add that the Application for Direction was filed on 14/07/2017, long before the Further Further Amended Writ of Summons and statement of claim were filed, but there is nothing on record to show that indeed the Plaintiffs amended.....
