On 18th November 2020, the Third Party/ Judgment Creditor/Appellant/Applicant (hereinafter referred to as the Applicant) filed motion on notice before this court. The motion is seeking an order to Stay Execution of the order of this court dated 30th October, 2020 granting an order of mandatory injunction and other ancillary reliefs upon the grounds contained in the affidavit in support. The Applicant’s counsel attached exhibits to the application. I wish to make this comment from the onset. The heading of the motion asked for two reliefs, namely: (a) An order to set aside the order of this court dated 30th October, 2020 which granted an order of mandatory injunction and other reliefs or (b) An order to Stay Execution of the order dated 30th October, 2020 granting an order of mandatory injunction.
