JUDGMENT On 26th October 2022 this court ordered the parties to file their respective written submissions on or before the 7th day of November, 2022 simultaneously for judgment to be delivered on 9th November, 2022. As at the 2pm of 8th November, 2022 and at the time of writing this judgment none of the parties had complied with the order of the court. I could have gone ahead to strike out the appeal for want of prosecution but looking at the nature of the appeal it will serve a useful purpose if I determine same on its merits without the appellant submission. I must say that few minutes after 2pm I received the written submission of the Respondent counsel which was filed out of time but since same has been filed I cannot close the door of justice by ignoring it. I hereby regularize same as if it was filed within time. As for the Appellant counsel he has gone to sleep but that notwithstanding I shall go ahead to deliver the judgment as the law demands.
