RULING The case from which the present application for stay of execution pending appeal has a long history. The present application is praying for an order staying execution of the alternative Judgment for an order for judicial sale of H/No.168 Kofi Dzata Street, Dzorwulu, Accra made in Suit No. RPC/176/12 pending the determination of an appeal against the Ruling of this Court dated 21st March, 2022 which Ruling dismissed the Plaintiffs action filed on 6th July, 2021.This Court dismissed the action on the grounds that same was frivolous, vexatious and abuse of Court process. The Defendant/Respondent/Respondent (hereafter called the Defendant) sued the three Plaintiffs/Appellants/Applicants (hereafter referred to as the Plaintiffs) at the High Court, Accra and obtained judgment against them.
