KWASI ASARE vs. JOSEPH PADI

JUDGMENT Introduction On 11th October 2022, I entered judgment in favour of the plaintiff in respect of reliefs (a) and (c) endorsed on the writ of summons and in place of relief (b), I granted the plaintiff the relief of recovery of possession. I however adjourned my reasons to today 20th October 2022 which I will proceed to give. Plaintiff’s case The writ in this suit was issued on 18th August 2021 for the following reliefs: i. An order for declaration of title in respect of all that piece or parcel of land situate and lying at Dunkonah, New Bortianor, Accra in the Greater Accra Region of the Republic of Ghana containing an approximate area of 5.7 acres more or less and bounded on the north by a proposed road measuring 200 metres more or less, on the east by a proposed road measuring 350 metres more or less, on the west by a proposed road measuring 350 metres more or less and bounded on the south by a proposed road measuring 300 metres more or less. ii.
