JUDGMENT On 5th March, 2021 Plaintiff instituted action against the Defendants claiming the following reliefs: a. Declaration that the Plaintiff is entitled to quiet and peaceful possession of the land described in paragraph 3 of the Statement of Claim and the portions particularly trespassed upon by the 1st Defendant. b. Perpetual injunction restraining the 1st Defendant, its agents, workmen, recruits and any person claiming through it from shooting bullets unto Plaintiff’s land and trespassing in any manner or form unto his land. c. Damages for trespass. d. Costs. The incontrovertible facts leading to the writ are that Plaintiff is a businessman and the owner of a parcel of land situate at Whindo-Apremdo. The 1st defendant is the Commanding Officer of the 2nd Battalion of Infantry of the Ghana Armed Forces whilst the 2nd defendant is in charge of defending and prosecuting legal matters on behalf of the Government.
