RULING In this application, the Defendant/Judgment Debtor/Applicant (hereinafter called the “Defendant”) is praying the court to set aside the judgment entered against him in favour of the Plaintiff/Judgment Creditor/Respondent (hereinafter called the “Plaintiff”). Applicant is also praying the court to grant him leave to file appearance and defence out of time. The background facts leading this application are that on 29th May, 2020, the Plaintiff herein instituted action against the Defendant for the following reliefs: 1. An order of the court to evict the defendant from the Plaintiff’s Plot No. 148C, situate at Assakai and within the North Whindo Planning Scheme and now being developed by the Defendant. 2. Damages for trespass unto the said land. 3. Recovery of possession. 4.
