RULING In this motion on notice, the Plaintiff/Judgment Creditor/Applicant (hereinafter called the “Applicant”) is praying the court for an order waiving the requirement for the payment into court the purchase sums upon the public auctioning of the attached properties of the Defendants/Judgment Debtors/Respondents (hereinafter called the “Respondents”). From the entirety of the motion paper, the supporting affidavit and written submission of learned counsel for the Applicant, the application is made pursuant to Order 45 Rule 7 of the High Court (Civil Procedure) Rules, 2004 (CI 47). However, in the motion paper the rule was misstated as Order 47 Rule 7. This is a mere slip which does not affect the substance of the application. The background facts leading to this application are that the High Court (Commercial Division) delivered judgment in favour of the Applicant on 18th March, 2019.
