Brief facts of the case On 23rd September, 2020, Prince Kludzi, Complainant, filed a complaint at the National Labour Commission against AGS Worldwide Movers Limited, Respondent, over a claim of "Company refusal to pay End-of-Service Benefits (ESB)." The Complainant submitted that he worked with Respondent company for over 12 ½ years and resigned early September, 2020. The Complainant seeks relief of payment of End-of-Service Benefits. The Commission referred the complaint to the Respondent for its response and per letter dated 15th January, 2021, the Respondent confirmed the resignation by Complainant from the employment of the Respondent company and listed his settlement package, i.e., Entitlement-Benefits and Deductions. The matter was heard at facilitation but facilitation failed. Of the three invitations to the facilitation meetings, Respondent only honoured one invitation.
