JUDGMENT KULENDI JSC:- INTRODUCTION By a unanimous decision on the 14th of December, 2022, we dismissed in its entirety, the appeal by the Plaintiffs/Appellants/Appellants (hereinafter called the Appellants) and reserved our reasons, which we hereby give. The said appeal is against the judgment of the Court of Appeal dated 25th July, 2016, which affirmed a judgment of the High Court dismissing the Appellants’ claim to house No. B59 Mfuom Road, Dunkwa-on-Offin and upholding the Defendants/Respondents/Respondents’ (hereinafter called the Respondents) counterclaim to the property. BACKGROUND The Appellants filed a writ of summons at the registry of the High Court, Cape Coast on the 16th of April, 2012 against the Respondents, seeking the following reliefs: 1.
