WELBOURNE, J.A This appeal is mounted against the judgment of the High Court dated 8th March 2013. The Plaintiff/Respondent will be described as the Respondent while the Defendants/Appellants will be described as Appellants. FACTS The brief back ground facts are that the property which is the subject matter of the litigation was originally owned by Great African Insurance Company Limited. The Company was a third party in a motor accident case entitled: Suit No. C3/95 Apaloo vrs Azmi Kanj and Great African Insurance Company Limited. During the course of the trial of the case precisely on the 23rd day of April, 1999, Great African Insurance Company Limited was ordered by the court to furnish it with security of (ȼ100,000.00) One Hundred Million Cedis (old currency) or other acceptable security that will satisfy any judgment given against the Company in the said suit.
