Introduction: [1] My Lords, the rules of court allow a victorious party in any civil suit the right to enforce the judgment of the Court of law in his/her favour unless the adversary succeeds subsequently in asking the Court to stay the execution of the judgment pending the result of an appeal if the orders are executable. The application before us is for stay of execution pending the determination of a Garnishee Order Absolute dated 18th September, 2020 and the judgment of this court dated January 19, 2023 pending the determination of the Applicants’ appeal against the January 19, 2023 judgment. The question is have the Applicants met the threshold for the exercise of our discretion in their favour? [2] The High Court, Commercial Division on September 18, 2020 granted a Garnishee Order Absolute against Vanguard Assurance Company Limited for the benefit of the Respondent.
