AMOS NYAMEKYE vs THE REPUBLIC
The appellant, aged 21, was charged and convicted for defilement of a 12-year-old stepdaughter, Georgina Owusu Agyapong, under Section 101(1) and (2) of the Criminal Offences Act, 1960 (Act 29) as amended. The appellant, engaged to tutor the victim, lured her to a friend's room and defiled her on two occasions, resulting in the victim becoming pregnant. The appellant pleaded guilty and was sentenced to 12 years imprisonment with hard labour by the Circuit Court, Juaben.

This is an appeal by the Appellant from the judgment of the High Court, Kumasi dated 23rd July, 2021 which reduced the sentence of twelve (12) years imprisonment IHL imposed on the Appellant by the Circuit Court, Juaben, Ashanti on 29th October, 2019 to nine (9) years imprisonment IHL. The only ground of appeal is that the sentence is harsh and excessive in the light of the discovery of new facts. The relief sought by the Appellant is for the Court to reduce the sentence imposed by the High Court, Kumasi. The Appellant was arraigned before the Circuit Court, Juaben and charged with one (1) count of defilement of a female child under 16 years of age contrary to Section 101(1 and 2) of the Criminal Offences Act, 1960 (Act 29) as amended by Act 554 of 1998.The facts of this case as presented by the Prosecution are that the complainant is a lotto agent residing at Ntonso with the victim Georgina Owusu Agyapong who is his step daughter aged twelve (...
