JUDGMENT BAAH, J.A This appeal challenges the decision of the Circuit Court, Fiapre, dated 10 February 2020. RELIEFS OF RESPONDENT On 3 May 2019, the plaintiff/respondent (hereafter respondent) issued a writ of summons for the following reliefs: a. An order for declaration of title to and recovery of possession of all that piece and parcel of land situate at Nanketewa on Sunyani stool land and bounded by old footpath, Kofi Kumah, stream, old banana trees, Yaw Barima and Maame Benewaa, with cocoa trees and particularly described in paragraph 13 of the statement of claim. b. General damages for trespass. c. An order of perpetual injunction restraining the defendant, his privies, family members, etc. from interfering with plaintiff’s enjoyment of the disputed land. CASE OF RESPONDENT The respondent who was about 80 years at the time of the action, by her pleadings claimed that her late father named Nana Kwasi Anto, alias Nana Kwasi Bosoma, who was the first Kyidomhene of Suny.....
