JUDGMENT KWAMINA BAIDEN, JA. The Appellant in this appeal is the customary successor of the late Emmanuel Asante. He applied to join a suit instituted Plaintiff/Respondent (hereinafter referred to as the Respondent) against the Administrator-General, in her capacity as the administrator of the estate of Emmanuel Asante (deceased). The application for joinder was refused by the High Court, Kumasi. This appeal is in respect of the decision of the High Court dated 5th July, 2022 which dismissed the application for joinder. By a writ of summons dated 4th April, 2022, the Respondent instituted an action against the Defendant in her capacity as the administrator of the estate of Emmanuel Asante (deceased) for the following reliefs. a.
