JUDGMENT BAAH , J.A A. BACKGROUND On 14 November 2017, the plaintiff/respondent (hereafter Respondent), instituted an action in the High Court, Obuasi, Ashanti, against the defendant/appellant (hereafter Appellant), seeking the reliefs of: (a) Declaration of title to a parcel of land located inside the Greenbelt Forest Reserve at Ahansonyewodea, in the Adansi, which said land was released to the respondent’s stool by the Forestry Department of the Forest Service Division, for both farming and residential purposes (b) Recovery of possession (c) Damages for trespass (d) an order for perpetual injunction and (e) any other reliefs deemed fit by the court. On 4 December 2017, the Appellant filed a statement of defence in which he counterclaimed for similar reliefs as the Respondent. The statement of defence and counterclaim were amended on 21 November 2018.
