By Writ of Summons issued on 14th June, 2013 the Plaintiff/Respondent (hereinafter referred to as “the Respondent”) claimed against the Defendants/Appellants (hereinafter referred to as the Appellants”) jointly and severally for:- a. A declaration that the property known as No. 13, Volta Avenue, Ridge Residential Area, Kumasi did not form part of the estate of the late Dr. Kwame Safo-Adu; b. A declaration that the Respondent is the owner by purchase of the property No.13 Volta Avenue, Ridge Residential Area, Kumasi; c. An order for recovery of possession; d. Damages for trespass; e. An order of injunction restraining the [Appellants], their agents, workmen and assigns from in any manner interfere with the [Respondent’s] ownership and possession of property No. 13, Ridge Residential Area, Volta Avenue, Kumasi; and f. An order seeking to set aside the assignment executed in favour of the 2nd [Appellant] by the 1st [Appellant]. ...
