OLD PARK ENGINEERING SERVICE vs. CASSEL ENERGY LTD. & ANOR

I have listened to the submissions by counsel for the parties as to whether the Defendants counsel’s application for the Defendants to engage another valuer in respect of this case to value the property again should be granted or not. On 3th November, 2022, the Applicant herein filed a motion on notice for extension of time to pay an amount the Applicant bought the attached property in this case through an auction. The motion was served on the Plaintiff and the Defendants. The Defendants/Judgment Debtors filed affidavit in opposition. The case was called for hearing on 7th February, 2023. On that day, counsel for the Plaintiff, Defendants and the Applicant were all present in court. Counsel for all the parties agreed that it will be fair and just for the attached property to be revalued because the last valuation was done about four years ago.
