On 14th October, 2022, counsel for the Defendants/Applicants (hereinafter called the Applicants) filed a motion to set aside or strike out the Plaintiff’s writ of summons. The motion is supported by affidavit. The motion was opposed by the Plaintiff/Respondent (hereinafter called the Respondent). The motion was heard on 8th February 2023. When the motion came up for hearing, counsel for the Applicants contended that the Respondent’s counsel had no valid licence when he issued the writ. In response, the Respondent’s counsel produced a practicing licence which showed that he had a practicing licence as of the time he issued the writ. Again, counsel for the Applicants contended that the writ did not conform to Order 59 of C.I.47. Counsel submitted, that the action should therefore be set aside or strike out.
