On 14th February 2023, the Defendant/Judgment Debtor/Applicant (hereinafter called the Applicant) filed a motion to set aside the entry of judgment filed by the Plaintiff/Judgment Creditor/Respondent (hereinafter called the Respondent). The entry of judgment under attack was filed by the Respondent on 2nd February, 2023. It is in respect of a judgment delivered by this court on 30th January, 2023. The motion is supported by affidavit. The Applicant main grounds in the affidavit in support are as follows; a) That the court did not fix the exact interest rate to apply in its judgment. b) That the interest rate should be at the time the order was made or the judgment was read and not the rate as it used to be in 2019. c) That there is no indication as to which bank rate the Respondent applied in its entry of judgment. d) That once the Applicant has not obtained the full judgment, it does not know which rate the Respondent used in its entry of judgment.
