THE QUANTUM GROUP LIMITED vs. JACOBSEN JELCO GHANA LIMITED AND JELCO AS, NORWAY

RULING On 26th October 2022, the Defendants/Applicants (hereinafter called the Applicants) filed a motion before this court. The motion is praying the court for an order to set aside the Writ of summons and statement of claim filed against them. The motion is predicate on the Plaintiff/Respondent’s (hereinafter called the Respondent), Writ of Summons which was issued on 29th July, 2021. The Applicants application is supported by affidavit. The relevant paragraphs are reproduced as follows:- 4. That at the hearing of this application, counsel for the Applicants shall seek leave of this honourable court to refer to all processes filed in this suit as if same had been set out in this affidavit in extenso and sworn to on oath. 5.
