JUDGMENT Plaintiff’s case The writ in this suit was issued on 13th October 2014 and later amended on 9th October 2017 after the 2nd defendant was joined to the suit. In the amended writ of summons, the plaintiff claimed the following reliefs against the defendants: i. An order of declaration of title to the land in dispute for the plaintiff. ii. An order for recovery of possession of the land in dispute to plaintiff. iii. An order on all trespassers to remove their various kiosks, structures and a further order to vacate the trespassed land. iv. An order for the removal of the repairer shop from the land in dispute. v. Perpetual injunction restraining the 1st and 2nd defendants by themselves, their agents and assigns from holding themselves as owners of the disputed land and vacate the trespassed land forthwith. vi.
