JUDGMENT Plaintiff’s case The plaintiff is a private individual who is trading under the name and style of Stanzac Enterprise. It is the plaintiff’s case that in April 2009, the defendant leased a parcel of land to him to build and operate a sanitary site for a period of twenty five years. The plaintiff fulfilled his part of the agreement and he constructed the Abese Sanitary Site which was used as a public place of convenience operated and managed by the plaintiff in accordance with the terms of the agreement reached with the defendant. The plaintiff however asserts that sometime in the year 2017, the defendant annexed the Abese Sanitary Site under the pretext of an alleged head count and contrary to the terms of the agreement reached with the defendant.
