JUDGMENT The plaintiff’s case is that the late Kwaku Boateng (deceased), a lawyer by profession and once an Attorney-General of Ghana in the 1st Republic sometime in the late 1990s together with others incorporated the Plaintiff ministry as a company limited by guarantee under the Companies, Act, 1960 (Act 179). The deceased served as the chairman of the Executive Council of the plaintiff ministry until his death in 2006 when he was substituted by one Reverend Stephen Mante. The deceased in his lifetime gave a part of his land situate at McCarthy Hill (and described in relief (ix) of the writ of summons) to the plaintiff for its church activities and this gift was confirmed by the deceased in his last will and testament dated 19th April 2005 which was admitted to probate on 17th March 2009. The plaintiff asserts that on the death of the deceased, the defendant, one of the surviving children of the deceased and who was at all material times present at the reading of the decease.....
