RULING I have listened to the submission by the Plaintiff’s counsel, praying the court to close the Defendants case. The Defendants last and only witness was discharged by the court on 22nd June, 2023. The case has since been adjourned about three times for the Defendants to produce their next witness if any, but they have failed to produce any other witness apart from DW1. The Defendants have called one witness in this case. However, the law is settled, that a party can win his case based on the quality of evidence led in the case by his witness or witnesses and not the quantity of the witnesses called. The evidence of a single witness if credible and reliable is sufficient to prove an issue in dispute. After all, witnesses are weighted and not counted. Therefore, a party does not prove his case by multiplicity of witnesses called but by the quality or credible or reliable evidence led at the trial by himself or by his witness.
