RULING This is a Ruling on Preliminary Legal Objection to the Defendant/Applicant’s hereinafter referred to as the Applicant’s Motion to dismiss the Plaintiff/Respondent’s hereinafter referred to as the Respondent’s suit. The brief facts of the matter is that on 19th January, 2023, the Respondent caused a Writ of Summons and Statement of Claim to be issued against the Applicant for reliefs endorsed thereon. The Applicant entered appearance and filed an Application to dismiss the Respondent’s suit. The Respondent filed an Affidavit in Opposition and also filed a notice of intention to raise preliminary legal objection to the Applicant’s Application to dismiss the suit on two main grounds namely: 1. That the Motion is legally and procedurally incompetent. 2. That the Applicant failed to properly invoke the jurisdiction of the Court with respect to the Application.
