The parties were married on 1 February 2014 under the Marriages Act. They have a seven-year-old daughter and lost another child during the marriage. Both parties jointly sought dissolution of the marriage citing irreconcilable differences. The petitioner alleged unreasonable behavior and desertion by the respondent, while the respondent accused the petitioner of adultery. The petitioner was locked out of the matrimonial home by the respondent, leading to separation.
read moreJUDGMENT The Petitioner on 31st January, 2022 invoked the court’s jurisdiction in a Divorce Petition pursuant to Section 1 of the Matrimonial Causes Act, 1971 (Act 367) and Order 65 rule 2 of the High Court (Civil Procedure) Rules, 2004 (C.I. 47) seeking the following reliefs: 1. That the marriage celebrated between the parties be dissolved. 2. That the Petitioner be granted custody of the sole child of female child of the marriage aged seven (years). 3. That the Respondent be ordered to contribute towards the health and educational bills of the said child. 4. That the Respondent be ordered to return all her certificates and vital documents. 5. That the following properties be settled in favour of the Petitioner and child. a. The plot of land at Efutu, Cape Coast. b. An amount of GH¢100, 000 as alimony. 6.
