ADWOA WOODE & 2ORS. vs. SAMUEL KOJO ACQUAH
RULING By their Writ of Summons issued on 4/08/2009 the Plaintiffs claim against the Defendant the following reliefs: (i) A declaration that plotting of portions of Plaintiffs’ land in favour of Defendant is a nullity. (ii) General damages for trespass onto Plaintiffs’ land. (iii) Recovery of possession. (iv) An Order of perpetual injunction restraining the Defendant, his agents, assigns and persons claiming through him from interfering with the Plaintiffs’ ownership and possession of the said land. (v) An Order cancelling any lease in respect of Plaintiffs’ land between the Defendant and any person. Pursuant to an Order of Substitution the writ of summons was amended on 4/03/2019 to substitute the original 3rd Plaintiff with the present 3rd Plaintiff. The former died in the course of trial – while he was being cross examined.
