EVANS AMOAKO MUSAH ABU vs. THE REPUBLIC
JUDGEMENT This judgment is in respect of an appeal against the judgment of the Circuit Court, Takoradi delivered on 1st March, 2022. The Appellant, Musah Abu (A2) together with Evans Amoako (A1) were charged with the following offences: 1. Conspiracy to steal contrary to Sections 23 and 124 (1) of the Criminal Offences Act, 1960 (Act 29). 2. Causing unlawful damage contrary to Section 172 (1) of Act 29. 3. Stealing contrary to Section 124 (1) of Act 29. 4. Dishonestly receiving contrary to Section 146 of Act 29. From the charge sheet, A1 and A2 were charged together under Count One i.e. conspiracy to steal. A1 was charged alone with Count Two i.e. causing unlawful damage. A1 and A2 faced the charged of stealing under Count Three. A2 was also charged alone with dishonestly receiving under Count Four.
