ODENEHO AKROFA KRUKOKO III vs. SOLOMON NTRAKWA & 11 ORS

RULING In this application, the 9th Defendant/Applicant, hereinafter called the “Applicant” is praying the court for an order to dismiss the suit on the following grounds: 1. For want of jurisdiction on grounds that; i. the plaintiff is not clothed with capacity ii. it is a cause or matter affecting chieftaincy 2. The suit is an abuse of the judicial process. The Applicant is coming under the inherent jurisdiction of the Court. Applicant’s case can be gleaned from a thirteen (13) paragraph affidavit in support of the application and a seven (7) paragraph supplementary affidavit which were further elaborated in the statement of case filed by his lawyer. It is the Applicant’s case that the Plaintiff/Respondent does not have the locus standi to mount the present action as he is not the Paramount Chief (Omanhene) of Wassa Fiase Traditional Area.
