ZAKARIA IDDRISU vs. THE REPUBLIC

JUDGMENT This judgment is in respect of an appeal against the judgment of the Circuit Court, Tarkwa delivered on 27th January, 2016. The Appellant was charged with conspiracy to commit crime to wit Robbery contrary to sections 23(1) and 149 of the Criminal Offences Act, 1960 (Act 29) and Attempt to commit crime to wit Robbery contrary to section 18(1) of Act 29. Appellant pleaded guilty to all the counts. He was subsequently convicted on his own plea and sentenced to fifteen (15) years in hard labour (IHL). The brief facts of the case as presented by the prosecution are that on 11th January, 2016 at about 7.00 am the complainant received a phone call from his security man that while he was on duty at the complainant small scale mine at 1:00 am, four armed robbers invaded the mine to rob and while the robbers were in there, one of the robbers shot at him and bolted away thereafter.
