STANBIC BANK GHANA LIMITED vs. DANNY PRAISE COMPUTERS & 2 ORS

RULING On 21st April, 2023, the 1st and 2nd Respondents/Applicants (hereinafter called the Applicants) filed a motion before this court. The motion is seeking an order to strike out the originating motion of the Applicant/Respondent (hereinafter called the Respondent). The motion is supported by affidavit. I wish to quote the relevant paragraphs of the affidavit in this ruling. 3. That I have the consent of the 1st Respondent/Applicant to depose to this instant affidavit in support on our joint behalf and benefit. 4. That the Applicant/Respondent herein by an originating motion filed on the 6th July, 2022 invoked the jurisdiction of this Honourable Court for an order to be made against the Respondents/Applicants herein for Reserve price and warrant for Possession of Collateral. 5. That upon receipt of the said Application, myself and the 1st Respondent/Applicant filed affidavit in opposition on 19th October, 2022. 6.
