THE REPUBLIC vs. GREGORY AFOKO AND ASABKE ALANGBI
The two accused persons, Gregory Afoko and Asabke Alangbi, were jointly charged with conspiracy to commit murder and murder of Adams Mahama, the then Upper East Regional Chairman of the New Patriotic Party, on or about 20th May 2015 at Bolgatanga. The initial trial ended with a hung jury on the murder charge, leading to a retrial order for the 1st accused, while the 2nd accused was convicted of conspiracy but not retried on murder due to lack of unanimous verdict.
read moreRULING On the 27th April 2023, under the direction of the Chief Justice, this case was assigned to this Court for retrial. The retrial became possible after the proceedings of the 27th April 2023 held before the High Court, General Jurisdiction 11 then presided over by Her Ladyship Justice Merley Wood, JA sitting as an additional High Court judge ended up with a hung jury. The two (2) Accused persons herein were jointly charged for the offences of: 1. Conspiracy to commit crime, namely Murder and Murder contrary to Sections 23 (1) and 46 of the Criminal Offences Act, 1960 (Act 29). The particulars of Count 1 was that, the two (2) Accused persons on the 20th May 2015 at Bolgatanga in the Upper East Region did agree to act together with a common purpose to commit crime namely murder.
