SUPERCARE COMPANY LIMITED vs. PATRICK AL-HASSAN ADAMAH

RULING The Plaintiff/Applicant (hereinafter referred to as “APPLICANT”) filed the instant application with a 13-paragraph Affidavit in support dated 9th November 2023. It is the case of the Applicant that on 11th June 2020, the Respondent purchased two hundred and fifty (250) 125CC Jincheng motorcycles at a unit cost of Four Thousand One Hundred Ghana Cedis (GHC 4,100) from the Applicant. Under the agreement it made with the Respondent, Respondent paid a deposit of GHC250,000.00 out of the total cost of One Million and Twenty-Five Thousand Ghana Cedis (GHC1,025,000.00) as agreed in the Agreement. That the Respondent was to make full payment of the outstanding debt within nine (9) months at an interest rate of 8% thus increasing the outstanding debt from Seven Hundred and Forty-Four Thousand, Seven Hundred and Fifty Ghana Cedis (GHC844,750.00) since Respondent failed to make payments within the nine months.
