RULING A. SUMMARY OF FACTS 1. The Complainants (Kennedy Ohene Darko and Joseph Entsie) by their engagement letters dated 21 August 2015 1 December 2017 respectively were employed as Security Guards by (Quemic Ghana Ltd) a private Security Company in Ghana. 2. By a dismissal letter dated 1 November 2018 issued by the Respondent (Cedar Integrated Security) and received by the Complainants and signed for on the 17 March 2020 the Respondent summarily dismissed the Complainants for breach of the Company's disciplinary code. (See Exhibit 4-Disciplinary Code at Article 4) 3. The Complainants claim they were called sometime in February 2020 and were informed that there was a fence cut and fuel theft from one truck, a night before they handed over to the day shift. The Complainants also claim that the Respondent breached sections 12 and 13 of the Labour Act (Act 651), and that their dismissal was unfair and unlawful since they were not given any hearing prior to their dismissal. ...
