ABDUL SALAM MONNIE vs. PAYFLEX MICROFINANCE COMPANY LIMITED
DECISION The disputing parties appeared before the National Labour Commission on 19th July, 2023 for a hearing in the above-named dispute. The Respondent was represented by the Head of Finance and led by Counsel. BRIEF OF FACTS OF THE CASE The Complainant filed a case as follows: 1. He was employed on 6th January, 2020 and his appointment was terminated on the 1st of September, 2021 on the basis of poor performance. 2. The reason provided by the Respondent for the termination of his employment is untrue. 3. A performance appraisal was conducted in July, 2021, to cover the performance of January 2021 to June 2021, the total score was 5 points and he scored 3.51 points which represented 70.20% of the total score. 4. The HR of the company had a meeting with him on 31st August, 2021 and asked him to resign from the company because of poor performance and it was followed by a termination letter dated 1st September, 2021. 5.
