EMMANUEL KWASI YEBOAH vs PRIORITY INSURANCE COMPANY LIMITED

The complainant, Emmanuel Kwasi Yeboah, was employed by Priority Insurance Company Limited for five years. He was involved in a car accident during an official trip, which was reported to the Police and DVLA for damage assessment. Subsequently, he was asked to step aside pending investigation and later his employment was terminated with one month's salary paid in lieu of notice. The complainant petitioned the National Labour Commission alleging unfair termination.

RULING A. SUMMARY OF FACTS 1. Emmanuel Kwasi Yeboah was an employee of Priority Insurance Company limited for a period of five years and was involved in car accident on an official trip. The accident was reported to the Police and DVLA invited to assess the damage. 2. The Complainant was issued with a letter to step aside while the accident was investigated. 3. The appointment of the Complainant was subsequently terminated and paid one months salary in lieu of notion. 4. The Complainant petitioned the Commission on 7th May, 2021 for Unfair Termination. B. RELIEF SOUGHT Commission Reinstatement 5. Respondent indicated that they exercised their right to terminate the the Contract of Employment of the Complainant under the Labour Laws, as they no longer needed the services of the Complainant. 6.
