JUDGMENT KULENDI JSC: Introduction: 1. This is a criminal appeal against the judgment of the Court of Appeal, Cape Coast dated the 6th of May 2020, affirming the sentence of twenty (20) years IHL imposed on the Appellant by the trial High Court in its judgment of the 5th of May 2004, after he had been convicted for the offence of Robbery contrary to section 149 of the Criminal Offences Act, 1960 (ACT 29) as amended by the Criminal Offences (Amendment) Act, 2003 (ACT 646). Facts: 2. On January 18, 2004, at or about 1:30 am, Gambo, a member of the North Kwesimentsim watchdog Committee, encountered the Appellant and three others. Upon being questioned, the Appellant and his accomplices claimed to be on an operation. Unconvinced, Gambo persisted and was threatened with a pistol by the 1st accused.
