VICTOR AMEWUGAH vs. THE REPUBLIC

JUDGMENT BAAH, J.A BACKGROUND The appellant was charged with two offences, namely, (a) murder, contrary to section 46 of the Criminal and Other Offences Act, 1960 (Act 29) and (b) robbery, contrary to section 149 of Act 29. The particulars of the offences were that the appellant who is a chain saw operator and aged 28 years, on 7 June 2013, did murder one Isaac Owusu aged 29 years and rob him of his Kia Rio taxi cab registered as No: AS 646-13. In the jury trial that ensued, the respondent called four witnesses, namely Thomas Obeng (PW1), Chief Inspector Eugene Ansah (PW2), Dr Ernest Kwasi Adjei (PW3) and Detective Inspector Alex Dwamena Dakwa (PW4). The appellant testified but called no witness. The submissions of counsel for the Republic and the appellant took place on 22 July 2016. On 27 July 2016, the trial judge summed up the evidence and the law for the consideration of the jury.
