JUDGMENT MENSAH-DATSA, JA. This is an appeal by the Defendant/Appellant (hereinafter referred to as Appellant) against the judgment of the High Court, Kumasi dated 28th February, 2022 in favour of the Plaintiffs/Respondents (hereinafter referred to as Respondents). The grounds of appeal are stated on page 140 of the Record of Appeal as follows: i. The learned trial Judge erred by failing to recognize that the Defendant did not commit any fundamental breach of the contract between the parties warranting the abrogation or repudiation of the contract by Plaintiffs. ii. The judgment is completely against the weight of evidence on record. iii. Additional grounds may be filed upon receipt of the record of appeal. No additional grounds of appeal were filed. The reliefs sought from the Court of Appeal are: 1. An order allowing the appeal and setting aside the judgment of the High Court dated 28th February, 2022 including the cost awarded. 2.
