The Respondents claimed ownership of a plot of land (Plot No. 12 Ward/Block “C” Residential Area, Zongo, Damongo) and sought to develop it. The Appellants prevented development, alleging a road separated the lands. The Respondents sued for declarations of ownership and rights, injunctions against interference, damages for trespass, and costs. The trial court granted all reliefs to the Respondents, including damages and costs. The Appellants appealed.

Respondents sought to develop the land but were stopped by the Appellants on the ground that there was a road separating Respondents’ land from that of the Appellants. Appellants persistently prevented the Respondents from developing the land. Respondents instituted this action against the Appellants in the trial High Court for the following reliefs: i.
