JUDGMENT OBENG-DIAWUO JA INTRODUCTION The Defendant appellant hereinafter called the defendant is the named Executor in the alleged last Will and Testament of the late John Ernest Obeng also known as Yaw Obeng who died on the 11th day of May 2016. The said appellant is also described in the purported Will as the nephew of the said John Ernest Obeng. THE FACTS The events culminating in the instant appeal unfolded this way. John Ernest Obeng hereinafter called the deceased was a man of significant means. It is not disputed that during his lifetime, he lived well as he was arguably very rich by all standards. He acquired a lot of landed properties dotted around various parts of this country including several houses. This is reflected in the purported Will and Testament which was fiercely contested by the parties herein.
