JUDGMENT KWAMINA BAIDEN, JA. This appeal arises out of a ruling of the trial Court refusing an application of the Defendant/Appellant to be called the Appellant, for an order to set aside/strike out the writ of summons of the Plaintiff/Respondent to be called the Respondent, for being incompetent and incurably defective. The Respondent per the said writ of summons claimed the following reliefs against the Appellant: 1. Declaration of title to all that property plot NO. 01203040506 Block 111 the disputed land popularly located and situated at Serwaa Akuraa Ejisu and shares boundaries with the properties of Nana Okese Afrane, Ejisu Omanhene’s private residence, Dr. Konto and Ejisu-Asamang Road. 2. For an order declaring any transaction purported to have been entered by the Defendant at the Lands Commission (if any) null and void. 3. An order for recovery of possession. 4. An order of perpetual injunction restraining the Defendant, his agents, assigns, workmen, servants, .....
