JUDGMENT OWUSU-OFORI, J. A INTRODUCTION This is an appeal from the judgment of the High Court, Kumasi, delivered on the 18th November, 2020 in which the Court dismissed a claim of $9,200 from the Plaintiff/Appellant against the Defendant/Respondent as being unmeritorious. I shall maintain the designations of the parties at the Court below. Thus, the Plaintiff/Appellant will simply be referred to as the Plaintiff and the Defendant/Respondent, as the Defendant. BACKGROUND FACTS: - The Parties who are all businessmen deals in imported used vehicle engines and ply their trade at Suame Magazine. Plaintiff averred that sometime in the year 2019, Defendant took his Nine Thousand Two Hundred Dollars (USD$9,200) to supply to him imported used engines. He averred further that, after the Defendant’s goods had arrived, he disposed/sold the consignment without delivering to him his consignment worth USD$9,200.
