JUDGMENT BAAH, J.A. A. BACKGROUND 1. The plaintiff/appellant (hereafter Appellant) is a financial institution incorporated under the laws of Ghana. It is involved in investment portfolios and provides financial services to individuals, institutions and corporate bodies. The 1st defendant (hereafter 1st Respondent) is a private Senior High School established by the 2nd defendant (hereafter 2nd Respondent) and is incorporated under the laws of Ghana. The 2nd Respondent is a religious organization similarly registered under the laws of Ghana. 2. The Appellant claim to have on 12 November 2015, granted a loan of GH¢100,000.00 with interest to the 1st Respondent for a period of eight months. According to the Appellant, the loan application was supported by the 2nd Respondent, which secured same with its landed property, being building on Plot No. 18A, Apromase, near Kumasi. 3.
