THE REPUBLIC vs. THE CIRCUIT COURT 1, ATTORNEY GENERAL EX: PARTE; PETER KOJO FOLI NKEGBE, ERICGBEHO

RULING In the month of February 2021 or thereabout, one Francis Techie Menson, who is one of the three Directors of Merlin Gaming Ghana Limited (MGGL) reported to the Ghana Police that Peter Kojo Foli Nkegbe and Eric Gbehu who are the other two Directors of MGGL, and who are the applicants herein, had stolen monies belonging to the Company. After investigations, the Police charged the Applicants with one count of Conspiracy contrary to Section 23(1) of Act 29 and three counts of stealing contrary to Section 124(1) of Act 29 before the Circuit Court, Accra, (1st Respondent herein). The Police presented the following facts to the Court in support of the Charges preferred against the Applicants; "Complainant Francis Tachie Menson is the Director and Shareholder of Merlin Gaming Ghana Limited and resides at Spintex. Accused persons Peter Kojo Foli Nkegbe and Eric Gbeho are also Directors of Merlin Gaming Ghana Limited and they reside at Airport Residential Area and Lashibi respectively...
