REPUBLIC vs. YAW BOADZIE DADZIE AND 4ORS. EX-PARTE: EBUSUAPANYIN KWAME EYIAH, DAVID MENSAH, OPANYIN PETER BOSU

JUDGMENT Introduction: The Applicant, Ebusuapanyin Kwame Eyiah, Head of the Nsona Royal Family of Gomoa Abrekum, David Mensah and Opanyin Peter Bosu have brought this contempt application in the interest of justice praying this Court to punish the Respondents for engaging in a conduct which amounts to disrespect towards the Court. The Applicants accuse the Respondents of breaching the terms of settlement which was agreed by parties in a previous suit and adopted by this Honourable Court as Consent Judgement. Although contempt of Court has not been specifically enacted, it nevertheless forms part of the inherent jurisdiction for the protection of the integrity and authority of the Courts from improper interference in the due administration of justice. In the case of Republic Vrs. Mensa-Bonsu & Ors [1994-95] 1GBR 131-281 SC, the Supreme opined that “there are two kinds of contempt; criminal contempt which consists in acts tending to obstruct or interfere with the due administr.....
