DANIEL OFORI vs. ECOBANK GHANA LIMITED

RULING The Injunction Application has been brought by Defendant/Judgment Debtor/Applicant (hereinafter called the Applicant) praying the Court to restrain the Plaintiff/Judgment Creditor/Respondent (hereinafter called the Respondent) from executing the judgment of the Supreme Court dated 25th July, 2018. The application was brought because the Applicant has an appeal pending against a decision of the High Court that struck out its pleadings and the whole suit for being an abuse in which the Applicant sought to set aside the said judgment of the Supreme Court dated 25th July, 2018 on grounds of fraud. It is this very judgment that the Applicant initiated a case at the High Court to set aside on grounds of fraud that the Respondent is also taking steps to enforce. The Applicant is therefore praying the Court to restrain the Respondent from executing the judgment because in the event that the appeal is successful, the subject matter will be lost.
