RULING INTRODUCTION On 3rd May, 2024, the Plaintiff filed a Writ against the 1st and 2nd Defendants claiming various reliefs endorsed on the Writ of Summons and Statement of Claim. The 1st Defendant and 2nd Defendant both entered Appearance by through their Counsel on 15th May, 2024. The 1st Defendant filed its Defence on 24th May, 2024 and the 2nd Defendant filed his Defence and Counterclaim on 27th May, 2024. At the close of pleadings, Counsel for Plaintiff on 1st July, 2024 applied for Directions and raised four issues. Counsel for 1st Defendant on 11th July, 2024 filed two additional issues and challenged the capacity of the Plaintiff to bring the instant suit and the jurisdiction of the Court. Counsel for the 2nd Defendant also filed three additional issues. At the hearing the application for directions on 29th July, 2024 the Court noted that the issue of capacity raised by the 1st Defendant ought to be dispensed with before the case can proceed.
