THE REPUBLIC vs. ERNEST ADOBA & RICHARD MARTEY

JUDGMENT This is an appeal against the sentence of the Circuit Court, Sekondi dated 12th September, 2023. The appellants herein were arraigned before the Circuit Court on the count of conspiracy to steal contrary to sections 23(1) and 124(1) of the Criminal Offence Act, 1960 (Act 29) and one count of stealing contrary to section 124 of Act 29 of 1960. At the hearing of proceedings before the trial Circuit Court, the Appellants pleaded guilty to both count. The trial Circuit Court, having listened to their pleas for mitigation sentenced them to a prison term of 2 years in hard labor on each of the counts. The sentences are to run concurrently. Dissatisfied with the sentence Appellants pursuant to an extension of time granted them by this Court on 23/01/2024 have appealed against the same.
